Provincial regulations mandate that a Record of Site Condition [RSC] must be filed with the Ministry of the Environment, Conservation and Parks prior to a change in land use, such as from industrial/commercial to residential.
An RSC can also be requested by a Region, City, Town, or financial institution as a part of their site development approval/lending process. RSCs can be filed to the Ministry following completion of all environmental and remedial work.
But what is an RSC?
An RSC are documents that provide a snapshot of the environmental condition of a property based on a Phase One and/or Two ESA. The ESA investigations must confirm that there is no evidence of contaminants at the property that would interfere with a future use of the property or that contaminants at the property do not exceed certain concentration limits. The limits being set are based on the intended land use.
So how do you file an RSC?
A package consisting of the documents listed below is submitted to the Ministry for review and comment.
Once submitted to the Ministry a technical review period follows prior to receiving comments and feedback. Once the Ministry is satisfied all requirements regarding the project site have been met, they will acknowledge the formal request for the change in land use.
Note: all RSC work must be completed by or under the direction of a Qualified Person with the Ministry of the Environment, Conservation and Parks and according to O. Reg. 153/04 as amended standards.
